Divorce without the other spouse present means a case continues and is decided even though one party does not attend court after being lawfully summoned. This usually happens after several notices go unanswered.

In real cases, this situation often arises when a husband disappears, moves without giving a new address, or deliberately avoids facing the wife’s claim. The court checks whether the notice was properly served before proceeding without his attendance.
