Syariah divorce in Selangor runs under the Enakmen Undang-Undang Keluarga Islam (Negeri Selangor) 2003, administered by the Jabatan Kehakiman Syariah Negeri Selangor (JAKESS).^[1] JAKESS hears every case through its Mahkamah Tinggi Syariah in Shah Alam and 12 Mahkamah Rendah Syariah spread across the state.^[2]

If your husband has failed to maintain you, disappeared, or hurt you, fasakh may be the route to ask the court to end the marriage. If he broke a taklik promise made at the akad, cerai taklik may apply instead.

Couples who agree to part can use khuluk, where the wife redeems the divorce, or a husband can pronounce talaq with the court’s permission. Once a divorce is granted, most people also raise hadhanah for the children and harta sepencarian for jointly acquired property.

Where do you file in Selangor?

Your case goes to the Mahkamah Rendah Syariah for the district where you live or where the marriage was registered. Shah Alam’s court sits at Persiaran Masjid, Seksyen 5, and also serves as JAKESS headquarters.^[2]

How the Sulh and hearing process runs

JAKESS runs its own Majlis Sulh, where the Registrar assigns a Sulh Officer and sets a mediation date within 21 days of registration.^[4] Claims such as mut’ah, nafkah iddah and child maintenance can be settled at this stage.^[4]
