Pengesahan lafaz cerai is the Syariah Court’s confirmation of a talaq pronounced outside court. It applies when the husband has already said the words, not when he is asking permission to say them.

The court examines what was said, when, and with what intent, then decides whether to confirm it as a valid divorce. Until that confirmation, the couple’s status stays uncertain.

What does the law require?

An out-of-court talaq must be reported to the Syariah Court, normally within seven days, so it can be registered and confirmed.[1] Failing to report it is an offence, carrying a fine of up to RM1,000 or imprisonment of up to six months.[2]

The reporting duty falls on the person who pronounced the talaq, which is usually the husband. His failure to report does not undo what was said, and you can still bring it before the court.

Is a WhatsApp or SMS talaq automatically valid and final?

No. A talaq sent by phone, SMS, or WhatsApp is treated as talaq kinayah, an indirect form of words that only takes effect where the husband genuinely intended to divorce at that moment.[3]

Even where intent is clear, the pronouncement still needs the Syariah Court’s confirmation before it is treated as a completed divorce.[3] A message on its own does not end a marriage.

This matters because some couples assume the marriage is already over once a message is sent. Until the court confirms it, the safer position is that the marriage status remains open.

What if your husband refuses to confirm or come to court?

You do not need his cooperation to apply. The confirmation process exists precisely for situations where the person who pronounced the talaq will not follow through.

How does the confirmation process work?

The process moves through set stages once you decide to apply.

  1. You file an application for confirmation at the Syariah Court, setting out what was pronounced and when.
  2. The court reviews the evidence, including messages, witnesses, or an admission from the husband.
  3. Both parties are usually given a chance to be heard, even if the husband does not attend.
  4. The court decides whether to confirm the talaq, and if confirmed, the divorce is recorded.

When is another route better?

If the words used were unclear, or your husband did not intend them as divorce, confirmation may not succeed. In that case, cerai talaq, fasakh, or khuluk may be the route that actually fits.

If the marriage has broken down through his failure to maintain you or his absence, rather than any pronouncement, fasakh built on those grounds may be the stronger path.

What should you prepare?

Evidence is central to a confirmation application. The type that helps most depends on how the talaq was pronounced.

  • The message itself, with the date, time, and full conversation for context.
  • Names of anyone who witnessed the pronouncement in person or by phone.
  • A clear, written account of the circumstances, prepared while the details are fresh.

Once the court confirms the talaq, the wife observes the iddah period, and the divorce is recorded. During this period, a revocable talaq may still allow rujuk if both spouses agree.
