Father's Custody Rights: when a father gets hadhanah

A father’s hadhanah right means a father is granted custody of a child, even though the law places the mother first in the order of preference. A father can hold this right if the mother has died, lost eligibility, or chooses not to claim it.

In real cases, fathers usually apply for hadhanah when the mother has moved far away without the child, has a serious mental health issue, or is found to have neglected the child. The court still treats the child’s welfare as the main question, not just the order of preference.
