Umur Mumayyiz: when a child can weigh in on custody

Umur mumayyiz refers to the age a child is considered able to tell things apart and give their own view, usually around seven years and above, though it is not a fixed cut-off and can vary with the court’s own assessment.

In a hadhanah case, the mother’s right of custody usually ends when a son turns seven or a daughter turns nine, though the court can extend this where it serves the child’s welfare. A mumayyiz child’s own view is sometimes taken into account, though the final decision still rests on the child’s welfare, not the child’s choice alone.

Each case is assessed separately based on the actual circumstances of the child and family.
