Cerai Luar Negara: a talaq pronounced outside Malaysia

Cerai luar negara happens when a talaq is pronounced while a couple is outside Malaysia, for example while working or living abroad for a time. That talaq must be brought for court confirmation in Malaysia before it is officially recognised here.

For example, if the husband pronounces talaq while in the Middle East, either spouse needs to file for confirmation at a Malaysian Syariah Court, following the same route as a talaq said outside court, with evidence of the date and how it was pronounced.

Without this confirmation, marital status in Malaysia stays unclear even though the divorce has already happened elsewhere.
