Why does a talaq pronounced overseas still need confirmation in Malaysia?

A talaq pronounced outside court, whether in Malaysia or overseas, does not automatically become a legal divorce under local law. It needs to go through an inquiry at a Malaysian Syariah Court before it is officially recognised.

This means that even though the husband already pronounced the talaq in another country, both spouses are still treated as married under Malaysian law until confirmation is completed.

What is the confirmation route?

A talaq pronounced outside court, including one said overseas, must be reported within seven days under section 55A, and the court holds an inquiry before confirming and registering it. Failing to report is an offence under section 124.^[1]

This route is the same one used for an out-of-court talaq pronounced within Malaysia, except that extra evidence may be needed to establish when and where it was said.

Why does this confirmation matter to you?
