Fasakh in Melaka is decided under the Enakmen Undang-Undang Keluarga Islam (Negeri Melaka) 2002, which received royal assent and was gazetted in late November that year.[1] Melaka’s judicial department calls itself Mahkamah Syariah Negeri Melaka (MSNM), rather than Jabatan Kehakiman Syariah, the more common name elsewhere.
The Mahkamah Tinggi Syariah Melaka sits at Kompleks Mahkamah Syariah Melaka, Jalan Ayer Keroh Lama, Hang Tuah Jaya, while the Mahkamah Rendah Syariah operates separately in Daerah Alor Gajah and Daerah Jasin.[2]
Where to file: Alor Gajah or Jasin
Alor Gajah runs its own district Syariah court, separate from the High Court at Hang Tuah Jaya. Jasin has a separate district court too, for residents further from the state capital.
File your fasakh application at the district court covering where you live, not automatically at Hang Tuah Jaya, unless your case falls under the High Court’s jurisdiction.
