What is an interim order?

An interim order is a decision the Syariah Court makes while your case is still going on, so you are not left without support or protection until everything is finally decided.

It covers you during the proceedings. It is not the final outcome, and the court can review it again as the case moves forward.

Can your children get maintenance while the case is pending?

Yes. The court can order maintenance for a child while divorce or maintenance proceedings are still going on, not only after the case ends.^[1]

This means you do not have to wait months, or longer, with no support at all while the full case is heard.

Can you get maintenance for yourself while the case is pending?

The court’s general power to order a wife’s maintenance can also be used to fix support for you while your own case is still pending, not only once it concludes.^[2]

Tell the court about your immediate needs, such as housing, food, and your children’s daily costs, so it can set a realistic interim figure.

Can the court protect your children while the case is ongoing?

Yes, in certain ways. An access order can bar a parent from removing a child from Malaysia while the case is ongoing, which matters if you are worried about your husband taking a child abroad.^[3]

Raise this concern with the court as early as you can, rather than waiting until it becomes urgent.

A police report or a protection order does not itself end your marriage, and it does not replace your Syariah Court case. You can pursue a protection order through the Domestic Violence Act alongside your divorce or maintenance proceedings, not instead of them.

How do you apply for an interim order?

You or your Peguam Syarie can raise the request for an interim order as part of your ongoing case, rather than starting a separate proceeding from scratch.

Be specific about what you need, whether it is monthly maintenance, an access arrangement, or a restriction on your husband’s actions, and explain why it cannot wait.

What should you prepare?

Bring records of your monthly expenses, your children’s school and medical costs, and anything showing your husband’s income or refusal to support you.

If your request relates to safety or travel, bring any police reports, messages, or other evidence of the specific risk you are describing.
