Talaq (divorce pronounced by the husband)

Talaq is the divorce pronouncement made by a husband to his wife. Under Malaysian law, a husband cannot simply pronounce talaq whenever he wishes; he must first apply to the Syariah Court for permission.

A typical case: a husband who wants a divorce files an application, the court attempts reconciliation, and if that fails, the talaq is pronounced before a judge and formally registered.

A talaq said outside court, for example during an argument or in a WhatsApp message, still needs to be confirmed by the court and reported within a set period that varies by state.
