Talak Tebus: when a wife redeems her divorce

Talak tebus is the common name for a divorce the wife redeems, where she pays her husband a sum of money or property, called iwadh, in return for the divorce pronouncement. It is formally known as khuluk.

A wife usually applies for talak tebus when she wants a divorce but has no clear fasakh ground, or her husband will not pronounce the divorce voluntarily. If the iwadh amount is not agreed, the court sets it based on both parties’ circumstances.

This type of divorce is bain sughra, meaning the husband cannot take his wife back without a new marriage contract.
