Permohonan: how a Syariah Court case starts

Permohonan is the written application filed with the Syariah Court to start a case, whether divorce, maintenance, custody, or another claim. It states who the applicant is, what is being asked for, and why.

For example, a wife filing for cerai taklik because her husband broke his marriage promise will fill in a permohonan setting out the marriage facts and how the taklik was breached. This application is then registered as a kausa in court.

The content must be accurate, since it forms the basis of the whole proceeding. Anything left out usually needs to be corrected through a further affidavit.
