Custody Order (Perintah Jagaan)

A custody order, or perintah jagaan (hadhanah), is the court’s decision on who cares for a child after divorce and how that responsibility is carried out.

The law treats the child’s welfare as the top priority, and usually gives the mother preference at the early stage.^[1]

In real cases, the court also looks at practical facts, like who actually cares for the child day to day, how stable the home is, and the child’s safety.
