Fasakh (court dissolution of marriage on specific grounds)

Fasakh is a wife’s application to the Syariah Court to dissolve her marriage on specific grounds recognised by law, and it does not need the husband’s consent.

A common case: a wife who has not received maintenance for several months, or whose husband has gone missing for over a year, can file for fasakh and bring evidence to court.

The grounds and section numbers differ slightly by state, but the underlying concept is the same across Malaysia.
