Custody Across States: when parents live apart interstate

Cross-state custody describes a situation where divorced parents live in different states, and a hadhanah or access order needs to work across state lines. Each state runs its own Syariah Court and enactment.

In real cases, common problems include a parent who relocates for work while holding hadhanah, or the other parent who must travel far to exercise access. An order made in one state generally still applies in another, though enforcing it may need a further application.

When one parent moves without informing the court or the other party, this can undermine the court’s confidence in the existing arrangement’s stability, and may open the door to an application to vary the order.
