Cerai Talaq: a husband's divorce pronounced with court permission

Cerai talaq is a divorce pronounced by the husband, but it must be made before the Syariah Court with the court’s permission, not on his own outside court. This differs from a talaq said at home, which needs separate confirmation.

For example, after both parties attend a Sulh session with no settlement, the court can allow the husband to pronounce talaq before the judge, and the divorce is recorded officially at that point.

Cerai talaq is often the route when the husband himself agrees to release his wife, unlike fasakh, which does not need his consent. When both sides fully agree, it becomes a cerai persetujuan.
