Civil Divorce vs Syariah Divorce: the difference

Civil divorce versus Syariah divorce describes two separate systems for ending a marriage in Malaysia. Non-Muslim marriages are dissolved in the Civil Court under the Law Reform Act, while Muslim marriages are dissolved in the Syariah Court under a state’s Islamic family law.

In real cases, confusion often arises when one spouse converts to Islam while a non-Muslim marriage is still ongoing, or when a couple married overseas under civil law before one later converted. Which court has jurisdiction depends on the religious status at the point of the original marriage.

The process, duration and types of claims, such as maintenance or property, also differ between the two systems, since the Civil Court and Syariah Court operate under entirely different legal frameworks.
