Your rights under Islamic family law in Malaysia

You are unsure what you are entitled to and want a plain overview before anything else.

What rights are actually available to you?

Islamic family law in Malaysia covers more than the divorce itself. It sets out rights to maintenance, custody arrangements, a share of jointly acquired property, and protection while your case is ongoing.

This page connects these pieces so you can see the full picture, rather than searching for each right separately. For the routes to divorce itself, see proses cerai.

What are your maintenance rights?

During the marriage, your husband has a duty to provide for you and your children. If the marriage ends, you may be entitled to nafkah iddah for the iddah period, and mut’ah if you were divorced without just cause, alongside ongoing maintenance for any children.

These are assessed on your actual needs and his means, not a fixed formula, so it matters to describe your real situation clearly.

What are your custody rights?

The court decides custody, hadhanah, based on the welfare of the child, with a general order of preference that usually favours the mother for younger children, subject to conditions. Access for the other parent is also addressed separately, so neither parent is automatically shut out.

What are your property rights?

If you and your husband acquired property together during the marriage, you may be entitled to a share under harta sepencarian. This depends on your contribution, direct or indirect, not on whose name is on the title or the account.

Keep a simple record of what you contributed, whether money, effort, or unpaid work that supported the household, since this becomes evidence later.

What protection is available to you?

If you are unsafe, help exists outside the Syariah Court system too. Call Talian Kasih at 15999 for immediate support, and a protection order under the Domestic Violence Act can run alongside your Syariah Court case rather than replacing it.

Where should you start if several of these apply to you?

Start with whatever feels most urgent, whether that is safety, unpaid maintenance, or a decision about the children, and bring the rest into the same conversation with a Peguam Syarie. These rights are connected, and addressing them together usually gives a clearer, more complete plan than tackling them one at a time.

Common questions

Do these rights apply to me if I converted to Islam?

Yes. Once you are Muslim, these rights apply to your marriage regardless of your background, though the specific court and procedure may need confirming for cross-border or conversion cases.

Do I lose my right to maintenance if I am the one who wants the divorce?

Not automatically. Maintenance during the marriage and any iddah entitlement are assessed on the facts, including whether nusyuz is raised, rather than simply on who initiated the divorce.

What if my husband's name is on everything, including the house?

Title alone does not decide a harta sepencarian claim. The court looks at direct and indirect contribution, so keeping a record of what you contributed matters more than whose name is on the document.

Where do I start if several of these rights apply to me at once?

Start with whichever concern is most urgent, whether that is safety, unpaid maintenance, or the children, and raise the rest with a Peguam Syarie in the same conversation so nothing gets missed.

If you are unsure which of these rights actually applies to your situation, tell us what is happening and we will help you see the full picture.
