What is actually happening in a Sulh session?

A Sulh session is a guided, private conversation between you, your spouse, and a Sulh Officer, aimed at reaching agreement before the case goes to a full hearing. It is a discussion, not a trial.

Sulh itself sits outside Act 303. It runs under each state’s own civil procedure rules for Syariah cases, with a Sulh Officer chairing the process.^[1]

Who is actually in the room?

The Sulh Officer leads the session. Both spouses attend, and each may bring a Peguam Syarie if they have engaged one. Occasionally, a support person may wait nearby, though the discussion itself is between the parties and the officer.

It is a smaller, quieter setting than a courtroom. There is no public gallery and no witness box.

What gets discussed during the session?

The officer usually opens by explaining how the session will run. Both sides then get a chance to lay out their situation and what they are hoping to resolve, whether that is the divorce itself, child maintenance, or harta sepencarian.

After the joint discussion, the officer often speaks with each side separately, so each spouse can share concerns more freely before everyone comes back together.

What tone should you expect from the discussion?

The session is deliberately kept calm and non-adversarial. The officer is not there to establish blame, but to help both sides see where a workable agreement might exist.

This does not mean disagreement disappears. It means the format is built to keep the conversation productive rather than combative, even where feelings are still raw.

What is Sulh actually trying to achieve?

The goal is a settlement both sides can accept, recorded as a court order without needing a full contested hearing. This can cover the divorce, maintenance, or property together, depending on what is before the court.

A partial agreement is still useful. Settling some issues in Sulh, such as property, while leaving others for a hearing, can shorten what remains to be argued later.

What if the first session does not settle everything?

That is normal, not a failure. Some cases need a second session once both sides have had time to consider a proposal. Others move straight to a hearing where the outstanding issues are decided.

Either way, you keep your right to present your evidence fully at a hearing if Sulh does not resolve the case.

How does Sulh connect to the rest of your case?

Most Syariah civil cases pass through Sulh once they are registered, including divorce, maintenance, and property matters. A case that does not settle here can still move on to hakam or a contested hearing, depending on the nature of the dispute.
