The difference between a saman and a permohonan

What is the difference between a saman and a permohonan?
A saman is usually used when the action is disputed between two parties, for example one party claiming something and the other expected to respond. A permohonan is used when there is no direct dispute from another party, such as a one-sided application to the court.
Both determine how your case moves, including who needs to respond and within what timeframe. Recognising the type of document you have helps you understand your next step.
When is a saman usually used?
A saman is common in disputed claims such as contested maintenance, an unagreed division of harta sepencarian, or a fasakh case where the husband disputes the ground. The party who receives a saman needs to respond within the timeframe set by the court.
If you receive a saman, that does not mean you are at fault. It means the other party has the right to dispute the claim, and your case will be heard with both sides present.
When is a permohonan used instead?
